[Agreement of Daniel K. Youngs et. al. to sell land to James Roosevelt. 1880.]Articles of agreement made this 19th day of November A.D. 1880, between Daniel K. Youngs Thomas Youngs and Susan M. Youngs of Oyster Bay. Queens County N.Y. Parties of the first part and James A. Roosevelt of the City and County of New York party of the second part witnesseth.
First, the said parties of the first part for and in consideration of the sum of two hundred and fifty dollars for each and every acre of the premises herein after described and hereby agreed to be conveyed do hereby covenant and agree to and with the said party of the second part, that they the said parties of the fist part will grant and convey unto him the said party of the second part. All that certain tract of land situate at Oyster Bay. Long Island bounded on the North by the road leading from Oyster Bay harbor to the road leading from Oyster Bay Cove so called to Cove Neck and the land of Daniel U. Smith. On the east by land of Daniel W. Smith and Thomas Youngs. On the South by land of Thomas Youngs and on the west by Oyster Bay Harbor. Containing between sixty and seventy acres. And that they the said parties of the first part upon the payment to them of the said sum of two hundred and fifty dollars per acre for each and every acre contained in said tract of land will make, execute, and deliver unto him the said party of the second part a good and sufficient deed of conveyance conveying unto him the said party of the second part the fee simple of and to the said premises, which said deed of conveyance shall contain the usual full covenants of warranty as against the grantors. And the said party of the second part doth hereby covenant and agree to and with the said parties of the first part that he will purchase of then the said parties of the first part the hereinbefore described premises - and will pay unto them therefor the sum of two hundred and fifty dollars per acre for each and every acre thereof, payment of said sum to be made as follows - The sum of five hundred dollars on the execution of this agreement and the balance of said sum whenever the title to said premises shall have been ascertained - and the number of acres therein computed to the satisfaction of the said party of the second part. The examination of such title and the computation of such area to be consumated and ascertained with all reasonable dilligence. It is understood and agreed that all the covenants and agreements herein shall be binding upon the heirs executors and assigns of the respective parties hereto.
