[Gideon and Mary Wright deed East Norwich farm to Walter Franklin. 1822.]

This indenture made the twenty eighth day of September in the year of our Lord One Thousand Eight hundred and Twenty two Between Gideon Wright of the Town of Oysterbay in Queens County and State of New York & Mary his wife of the first part and Walter Franklin of the same Town County and State aforesaid of the Second part. Witnefseth That the said parties of the first part for and in Consideration of the Sum of Six Thousand Two hundred and fifty Dollars lawful money of the United States of America to them in hand paid at or before the ensealing and delivery of these presents by the said party of the Second part the reciept whereof is hereby acknowledged and the said party of the Second his heirs executors administrators forever released and discharged from the same by these presents: Have granted bargained sold aliened remised released conveyed and confirmed and by these presents Do grant bargain sell alien remise release convey and confirm unto the said party of the second part and to his heirs and afsigns forever All That Certain Farm or Plantation of Land situate lying and being at or near the Village of Norwich of Norwich in the Town of Oysterbay aforesaid in two Separate tracts peices or parcels, the first piece of which is Bounded as follows and it that on which the Dwelling House and other buildings now stands Viz. on the west partly by the Highway called Mill river hollow roads and partly by Bennetts Lands, on the North by Isaac Nostrands Lands: on the East partly by Common Lands and partly by the High Way Leading from Norwich to the Village of Oysterbay; and on the south partly by Thomas Roes Lands partly by William Davis's Lands and partly by Andrew C. Hegemans Lands to the place of Begining
containing by estimation one hundred and ten acres of Lands be the same more or lefs: The other peices lies adjoining the East side of the Last mentioned Highway leading from Norwich to the Village of Oysterbay and is bounded Southerly and Easterly partly by Elbert Hegemans Lands and Land now or late belonging to the Estate of James Weeks deceased; on the Northeasterly side by a roads leading from Eastwoods to Pine Hollow and thence Northwesterly adjoining said roads till it meets or intersects the above mentioned Highway that leads from Norwich to the Village of Oysterbay and thence Southerly adjoining said Highway to Elbert Hegemans Land aforesaid or place of begining being partly Cleared Lands and partly wood Land containing by Estimation between Fifty and Sixty acres of Land more or lefs as may be found within said bounds Also one Certain peice or tract of Salt meadow situate in the Village of Oysterbay aforesaid bounded on the South partly by a road called Oyster Lane and partly by Parish's Lands, on the East by Lands of Henry Fleet, on the North by Oysterbay Harbours or Highway and on the West by Lands of Horace Wright containing about seven acre more or lefs - Together with all and Singular that Tenements Hereditaments and appertenances whatsoever unto the said abovementioned and described premises in any wise appertaining or belonging and the reversion and reversions remainder and remainders rents Ifsue and profits thereof and also all the Estate Right Title Interest Lower and right of dower property pofsefsions claim and demand whatsoever as well in Law as in Equity of the said parties of the first part of in or to the same and every part and parcel thereof with the
appertenances To Have and to Holds the above granted and described premises with the appertenances unto the said party of the second part his heirs and assigns to his and their proper use benefit and behoof forever; Excepting and reserving neverthelefs to the said Gideon Wright and Mary his wife and their heirs forever a certain piece of Land seven rods long and six rods in width on the premises here in before granted and described to be preserved for the use and purpose of a burial ground and for no other use or purpose whatsoever and the privilege of a way or pafsage to pafs and repafs to the same from the highway with carriages on or otherwise for the use of the said Gideon Wright and Mary
his wife and their heirs and to such others as they may grant Liberty; to be located on such part of the above granted and described premises as shall be designated by the said Gideon Wright; and the said Gideon Wright doth further Except and reserve for himself and his family during the natural lives of the said Gideon Wright and Mary his wife and during the natural life of the Survivor of them and no Longer the following provisions and privileges on and about the premises above granted and described: That is to Say; the entire use of one large room, two Bed rooms, and one Chamber; and a Suitable and Convenient privilege in the Entry or Hall in the Kitchen and in the Cellar; all of which shall be in the Chief mansion or Dwelling House on the said premises a Sufficiency of pasture Hay and Provinder for one Horse and one Cow and barn room for the Same and Suitable Shelter for Carriages.
The Beehouse bees and beehives and all appertenances thereunto belonging a sufficiency of fire wood and a free way or pafsage to pafs and repafs with teams to and from the wood land on the said premises for the purpose of cutting and carting fire wood, a Sufficient and convenient Garden, a Sufficiency of all kinds of fruit that may grow on the said premises and also a free use of all the Springs of water wells and other watering places on and about the said premises and a way to and from the Same to the Dwelling and to the Highway; all which said provisions and privileges are hereby reserved and Excepted to and for the said Gideon Wright and Mary his wife as occassion may require for and during their natural Lives and the natural life of the survivor of them and no longer; and Gideon Wirght and Mary his wife for themselves and for their heirs executors and administrators Do covenant grant promise and agree to and with the said Walter Franklin his heirs and afsigns that the said Gideon Wright at the time of the sealing and delivery of these presents is Lawfully Seized in his own right of a good absolute and indefeasible Estate of Inheritance in fee simple of and in all and singular the above granted bargained and described premises with the appertenances and hath good right and Lawful authority to grant bargain and convey the same in manner as herein written and that the said Walter Franklin his heirs and afsigns shall and may at all times hereafter peaceably and Quietly have hold occupy pofsefs and enjoy the said above granted premises and every part thereof with the appertances (except as above reserved and excepted) without the Let suit trouble molestation or disturbance of the said parties of the first part or their heirs or of any other person or persons whomsoever, and that the same now are free clear discharged and unincumbered of and from all forces and other grants Titles charges Estates and Incumbrances of what nature or kind soever (except as herein before excepted and reserved) and also that the said party of the first part of their heirs, and all and every other person or persons whomsoever lawfully or equitably deriving any Estate right Title or Interest (except as herein before excepted and reserved) of in or to the herein before granted premises by from under or in trust for him or them shall and will at the request and
the proper costs and charges in the Law of the said party of the second part his heirs and afsigns; make do and execute or cause to be made done and executed all and every such further and lawful and reasonable acts conveyance and afsurances in the Law for the better and more effectually vesting and confirming the said premises in and to the said party of the second part his heirs and afsigns forever - and the said Gideon Wright and Mary his wife the above granted premises and every parcel thereof (except as herein before excepted) unto the said party of the second part his heirs and assigns will warrant and by these presents forever Defend. Be it remembered that on the twenty eighth day of September in the year one thousand eight hundred and twenty two before me A.C. Hegeman a commissioner for Queens County under the act of 24th March 1818 - personally - appeared Gideon Wright and Mary his wife to me well known to be the same persons described in and who have executed the within deed, and, they severally acknowledge that they had executed the same for the purposes therein mentioned; and the said Mary having been examined by me separate and apart from her said husband did acknowledge that she executed the same fully without any fear or compulsion of her said husband and finding no material alterations therein do allow that it maybe recorded
