152 DUNNIVANT, THOMAS. On May 24, 1759, the Amelia Co. Court, on motion of Hodges Dunnivant, ordered Daniel Wilson, John Worsham, William Walthall and George Ragsdale, or any three, lay off and assign Charity Dunnavant her dower in lands of her late husband, and that they divide his slaves and personal estate, and assign to sd. Charity and the children their parts and report to the court.

DUNNAVANT, THOMAS. May 27, 1759 by court order assigned to Charity Dunnavant: 1 Negro man Lewis, 1 feather bed and furniture, 1 side saddle and bridle, 1 calf, 1 pot and hooks, and 1 bottle, being the third part of the clear est. of her late husband, Thomas Dunnivant, dec?d. Hodges Dunnivant, heir-at-law, did not desire that sd. Charity should be thirded in the lands of her dec?d. husband. Wit. Daniel Wilson, George Ragsdale, William Waltall (sic).

d. Oct. 5, 1778, pro. (no date given). Wit. Thomas Walthall, Molley Walthall, Philip Dunnavant, William (X) Dunnavant & John Walthall. Ex. 2 Bros. Hodges & Clement Dunnavant.Leg: Bro. Frederic, my sorrel horse. Bro. Joel, gun and riding saddle. Bro.-in-law Daniel Murray & his present wife Ruth, 1 small piece of land for their lives, after which it is to be joined to the other tract again and to be possessed by the same person or persons I leave the other part of land to. sd. land bonded between two roads where sd. Daniel Murry now lives, supposed to be about 30 acres. Rem. est. real & pers. to dau Jane Dunnavant & my Negroes & increase; the Negro & increase my dau. Jane has with her now may not be taken away, but ? to be with her, and to wait on her, and do her business.? Bro. Joel to live on plant. if he chooses, to keep it in repair with my Negroes, and have profits he makes form produce of plant., only allowing my dau. Jane good maintenance out of profits of land & Negros. At Discretion of Ex., Bro. Joel may live on my plant. if he chooses till dau. Jane becomes 15, and he is to pay for her schooling; when she becomes 15, he is to deliver up the plant. in good repair with the same quantity of stock of all kinds to my Ex. or dau., if she marries. If dau. Jane dies without heir, my two bros. Joel & Frederick to have my land equally div. in quality & quantity, rem, part my est., Negroes, stock & hh. furn. of all kinds, to be equally div. between my 4 brothers, Hodges, Clement, Joel and Frederick.

Will of Daniel Dunnavant dated 10/22/1789 lists his wife as Rhoda and sons as Eldridge and Royley. Exec. as his brothers John and Abner.


Will of William Dunnavant - 1780 (Amelia County, Va)

In the name of God Amen this fourteenth of February the year of our Lord Jesus Christ one thousand seven hundred and eighty WM Dunnavant being weak in body but of perfect mind and memory thanks be to God. First, I so make and ordain this to day principally and first of all I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in decent christian burial at the discretion of my executors nothing doubting but at the General Resurrection I shall receive the same again by the Almighty Power of God and - - - - such wordly estate wherewith it hath pleased God to bless with in this life. I give devise and dispose of in the following manner and form.

Item, to my Loving wife Mary during her natural life or while she remains my widow the following slaves Sara, Diso, Patt & Gilliam and Sam, also I leave to my Dear wife my land and plantation where I now live during her natural life or as long as she remains my widow and - - - .

Item, I give and bequeath to my son William Dunnavant one negro woman Patt & Hannah - - - and D- -y the said negroes and their increase to my son William and his heirs forever and ever.

Item, I give and bequeath to my son Hezekiah Dunnavant one negro named Winny - - - - the said negroes and their increase to my said son Hezekiah and his heirs forever and ever.

Item, I give and bequeath to my son John Dunnavant - - - negro - - - - - - - - to said John and his heirs forever and ever and I also give and bequeath to my son Daniel Dunnavant one negro named Sam - - - - - - and their increase to my son Daniel and his heirs forever and ever also to my said son Daniel one feather bed.

Item, I give and bequeath to my son Abner Dunnavant one negro named Sarah and one negro boy Ned the said and their increase to my said son Abner and his heirs forever and ever. Also I give to my said son Abner one feather bed.

Item, I give and bequeath to my daughter Pheby Roberts one negro woman named Judy and one negro girl named Dido the said negroes and their increase to my said daughter Pheby and heirs forever and ever.

Item, I give and bequeath to my daughter Mary Dunnavant one negro girl - - - and one negro girl named - - - - the said negroes and their increase to my said daughter Mary and their heirs forever and ever Also I give to my said daughter one feather bed and also a horse and saddle.

Item, I give and bequeath to my sons Daniel and Abner my land and plantation where I now live to be equally divided between my two sons Daniel and Abner and their heirs forever and ever but my said sons Daniel and Abner - - - - - - - - - - - - with the said land and plantation before their decease or marriage of my dear wife Mary and then let them divide - - - themselves and cast lots or draw for their part.

Item, I give and bequeath to my two sons Hezekiah and John my two hundred acres of land I have in Prince Edward County to be equally divided to my said sons Hezekiah and John and their heirs forever and ever and let them divide it themselves and then cast lots or draw for their part.

Item, to my loving wife Mary all the remainder part of my estate as I have not mentioned in my will during her life or while she remains my widow and after the decease or marriage of my dear wife Mary then the said goods and chattels to be equally divided between John, Daniel, Abner, and Mary and that they divide it themselves without the concern of anybody or the trouble of the - - -, my will and desire is that my three sons William, John and Daniel, I do appoint executors or this my last will and testament - - - all others or former wills here before made by me and this only to be my last will and testament. In witness hereto I have hereunto set my hand and affix my seal the day & year first above written and I desire that my executors - - - my daughter Mary and let her life with them and take care fo her and what she has.

Will of Abner Dunnavant - 1832 (Amelia County, Va.)

I, Abner Dunnavant ( ) This my will

Item 1. I will all of my estate subject to the payment of my just debts.

Item 2. I will to my wife Phoebe Dunnavant during her natural life the plantation whereon I now live and ( ). Item ( ) the stock ( ) plantation utensils as well as ( ) household and kitchen furniture for the support of herself my two daughters Betsy and Patsy

Item 3. After the death of my wife I give to my daughter Patsy one negro named Charlotte and her increase one bed and furniture one trunk and a secretary.

Item 4th. After the death of my wife I give to my daughter Betsy one negro named Jim and one bed and furniture.

Item 5th. After the death of my wife I give to my son William Dunnavant one negro (man?) named Ned.

Item 6th. All ( ) that I have in my possession are the property of my three daughters Rebeccah, Patsy, and Nancy purchased (for) them several years ago and all the cattle was purchased by Rebeccah and Patsy which property I do not feel myself ( ) to dispose of.

Item 7th. I give to my son Daniel one negro by the name of (Jody?) to him and his heirs forever.

Item 8th. I give to my son John one negro by the name of Lucy to him and his heirs forever.

Item 9th. I give to my son (Kennon or Gannon?) one negro by the name of ( ) to him and his heirs forever.

Item 10th. I give to my daughter Rebeccah one negro by the name of ( ) to her and her heirs forever.

Item 11th. I give to my daughter Nancy one negro by the name of (Amy?) during her life and to her heirs. But if she dies without ( ) the same negro is to return to my heirs with her increase.

Item 12. I give to my son Leonard one negro by the name ( ) of to him and his heirs forever.

Item 13th. I give to my daughter Sally one negro by the name of Joseph to her and her heirs forever.

Lastly, I do hereby appoint my two sons John and (Gannon or Kennon?) Dunnavant executors to this my last will and testament. ( ) I have hereunto ( ) my hand and seal this nineteenth day of January one thousand eight hundred and thirty two.

WILL OF J. GEORGE DUNIVANT

Noncupative Will of J. G. Dunivant died. Set up and established at September four 1889 & observed to be recorded. Recorded Sept 24, 1889. W L Wilkerson Clerk

On the 2nd day of September 1889 J. G. Dunivant decreased in his last sickness at his own habitation in Dyer County, declared in the presence of the undersigned whom he especially requested to bear witness thereto that his Will was as follows: That his daughter M.F. Dunivant have the household and kitchen furniture. That all the rest of his property both real and personal be divided equally between his eight children (or the heirs of those who are dead).

Mrs Mary A. Wynne. Mrs Cora Townsend, Mrs Mary F. Wynne died, Miss M. F. Dunivant, J. H. Dunivant, W.I.Dunivant, J B Dunivant and F. A. Dunivant. The said J H Dunivant died on the 4th day of September 1889. Written and signed by us on the 23d day of September 1889. Guy Douglass F A Dunivant

In the matter of the noncupative Will of J G Dunivant - died.

This day a paper writing signed by Guy Douglass and F A Dunivant was produced in open court and propounded as the noncupative Will of J G Dunivant and it appearing that said Dunivant has departed this life and was a resident in Dyer County at the time of his death and it being proved to the satisfaction of the Court by the Oaths of Guy Douglass and F.A. Dunivant that said paper writing contains the disposition which the said Dunivant said he desired to make as to his property and affairs and what he wished done with them after his death and that said verbal directions were given by said Dunivant during his last sickness at his own dwelling house in Dyer County in the presence and hearing of both of said witnesses and that they were specially called upon by said Dunivant to bear witness thereto and that he was of sound mind and memory at the time.

That said verbal Will was reduced to writing and signed by them and it appearing that the heirs have been duly cited to appear here at this day and take such actions as they see proper relative to the probate of said Will and it further appearing from the Oaths of said two witnesses that said paper writing contained the verbal noncupative Will of said Dunivant and that the same should be established as such. It is therefore ordered by the Court that said paper writing be set up and established as the Last Will and Testament of said J G Dunivant and that the same be recorded in Will Book and filed.

Will and Testament of Flem Dunivan

In the matter of the last will and Testament of Flem Dunivan filed March 6, 1916 and approved Mar. 6, 1916 and recorded Mar. 6, 1916.

In the name of God, I, Flem Dunivan of the county of Dyer and the State of Tennessee being of sound and disposing mind and memory do hereby make, publish, and declare this to be my last will and testament.

FIRST: I direct all my just debts to be paid, as soon as possible after my deceased.

SECOND: I give and bequeath all my personal property of all kind and discription that I die seized and possessed of that is left after my debts are paid, to my wife Catherine Dunivan.

Third; I give devise my real estate, being about fifty acres of land that I Bought from Mulherin and being in seventh civil district of Dyer county and partly lying on lewis creek to my wife Catherine Dunivan, absolute, for her natural life.

Fourth After the death of my wife, I will and devise said real estate to to my lawful heirs, to be divided equal between them.

Fifth I nominate, appoint and constitute for my execotro Van Prichart of this my last will and testament, and that he shall act without bond.

Sixth; I direct my said executor to sell enough of my personal property privately on publicly to pay my just debts and burrial expenses.

In testamony wheresof I have hereunto set my hand and seal by making my mark, this the 9 day of November 1915.
