Chapter 5. Crimes.

§ 521. Escape.

1.    No person shall be convicted of escape unless it can be proven that they intentionally or recklessly removed themselves or aided another person in removing themselves from arrest, detention while awaiting trial, detention during trial, or detention following conviction, without the consent of the plaintiff or the person responsible for overseeing the detention.

2.    If the defendant is convicted for escape from an arrest, or from detention while awaiting trial or during trial and is acquitted of all other charges, escape shall be punished by a term of not more than two years imprisonment and damages of not more than £2,000.

3.    If the defendant is convicted for escape from detention while awaiting trial or during trial and is convicted of additional charges, or following conviction, escape shall be punished by a term of imprisonment of one-half the sentence and damages of one-third of those awarded by the jury on the other charges.

4.    If the defendant is convicted of escape while serving a term of life imprisonment, escape shall be punished by damages of one-half of those awarded by the jury on the charges for which the defendant was sentenced to life imprisonment.

5.    Only the plaintiff in the crime or alleged crime for which the defendant was arrested or detained may charge escape.
