Chapter 5. Crimes.

§ 514. Breach of Contract.

    1.    No person shall be convicted of breach of contract unless it can be proven that he failed to fulfil an obligation voluntarily undertaken in a valid contract.

    2.    The plaintiff shall be allowed to choose one of three measures of damages:
            a.     Damages sufficient to place the plaintiff in the financial position he would have been in had the contract been fully performed; or
            b.     Damages sufficient to place the plaintiff in the financial position he would have been in had there been no contract; or
            c.     Damages sufficient to place the defendant in the financial position he would have been in had there been no contract.

3.    If the contract is for unique, rare, or sentimental goods, the plaintiff may request specific performance instead of damages.

4.    To recover damages, the plaintiff shall prove the amount lost and that the defendant could foresee the possibility of such damages.
