Chapter 5. Crimes.

§ 510. Trespass to Land.

    1.    No person shall be convicted of trespass to land unless it can be proven that, without consent of the landowner or without authority of law, he or material emitted from them or their property entered the real property of the plaintiff, caused damage to the real property of the plaintiff, or deprived the plaintiff of all or part of the value of real property.

    2.    "Material" shall include any physical object as well as intangible things such as, but not limited to, smoke, light, pollution, or odours. Such intangible things shall be required to cause harm to persons or property before damages may be awarded.

    3.    A mistaken belief that one is the landowner shall not be a defence to trespass to land.

    4.    The value of real property involved in a trespass to land shall be:
            a.     for real property not intended for sale, the fair market value;
            b.     for real property intended for sale, the intended sale value.

    5.    Trespass to land shall be punished by damages of not less than 1s and not more than £1,000. Each additional entry onto the same property shall increase the maximum damages by £1,000. Any of a trespasser's property left on the property may be removed by the lawful owner.
