Chapter 5. Crimes.

§ 506. Battery.

    1.    No person shall be convicted of battery in the first degree unless it can be proven that he intentionally caused serious bodily harm to the plaintiff without the consent of the plaintiff.

    2.    No person shall be convicted of battery in the second degree unless it can be proven that he:
            a.     recklessly caused serious bodily harm to the plaintiff without the consent of the plaintiff; or
            b.     intentionally caused bodily harm to the plaintiff without the consent of the plaintiff.

    3.    No person shall be convicted of battery in the third degree unless it can be proven that he recklessly caused bodily harm to the plaintiff without the consent of the plaintiff.

    4.    No person shall be convicted of battery in the fourth degree unless it can be proven that he intentionally or recklessly caused offensive contact with the plaintiff without the consent of the plaintiff.

    5.    No person shall be convicted of battery in the fifth degree unless it can be proven that he negligently caused serious bodily harm with the plaintiff without the consent of the plaintiff.

    6.    No person shall be convicted of battery in the sixth degree unless it can be proven that he negligently caused bodily harm with the plaintiff without the consent of the plaintiff.

    7.    No person shall be convicted of battery in the seventh degree unless it can be proven that he negligently caused offensive contact with the plaintiff without the consent of the plaintiff.

    8.    Battery in:
            a.     the first degree shall be punished by a term of not less than fifteen and not more than twenty years imprisonment and damages of not less than £100,000 and not more than £200,000;
            b.     the second degree shall be punished by a term of not less than ten and not more than fifteen years imprisonment and damages of not less than £50,000 and not more than £200,000;
            c.     the third degree shall be punished by a term of not less than five and not more than ten years imprisonment and damages of not less than £25,000 and not more than £200,000;
            d.     the fourth degree shall be punished by a term of not more than one year imprisonment and damages of not more than £100,000;
            e.     the fifth degree shall be punished by damages of not more than £200,000;
            f.     the sixth degree shall be punished by damages of not more than £100,000;
            g.     the seventh degree shall be punished by damages of not more than £50,000.
