Chapter 5. Crimes.

§ 505. Assault.

    1.    No person shall be convicted of assault in the first degree unless it can be proven that he intentionally caused the plaintiff to fear serious bodily harm and had the apparent present ability to cause serious bodily harm to the plaintiff, without the plaintiff's consent.

    2.    No person shall be convicted of assault in the second degree unless it can be proven that he:
            a.     recklessly caused the plaintiff to fear serious bodily harm and had the apparent present ability to cause serious bodily harm to the plaintiff, without the plaintiff's consent.; or
            b.     intentionally caused the plaintiff to fear bodily harm and had the apparent present ability to cause bodily harm to the plaintiff, without the plaintiff's consent..

    3.    No person shall be convicted of assault in the third degree unless it can be proven that he recklessly caused the plaintiff to fear bodily harm and had the apparent present ability to cause bodily harm to the plaintiff, without the plaintiff's consent.

    4.    No person shall be convicted of assault in the fourth degree unless it can be proven that he intentionally or recklessly caused the plaintiff to fear offensive contact and had the apparent present ability to cause offensive contact to the plaintiff, without the plaintiff's consent..

    5.    No person shall be convicted of assault in the fifth degree unless it can be proven that he negligently caused the plaintiff to fear serious bodily harm and had the apparent present ability to cause serious bodily harm to the plaintiff, without the plaintiff's consent.

    6.    No person shall be convicted of assault in the sixth degree unless it can be proven that he negligently caused the plaintiff to fear bodily harm and had the apparent present ability to cause bodily harm to the plaintiff, without the plaintiff's consent.

    7.    No person shall be convicted of assault in the seventh degree unless it can be proven that he negligently caused the plaintiff to fear offensive contact and had the apparent present ability to cause offensive contact to the plaintiff, without the plaintiff's consent.

    8.    Assault in:
            a.     the first degree shall be punished by a term of not less than ten years and more than fifteen years imprisonment and damages of not less than £50,000 and not more than £100,000;
            b.     the second degree shall be punished by a term of not less than five years and not more than ten years imprisonment and damages of not less than £25,000 and not more than £100,000;
            c.     the third degree shall be punished by a term of not less than one year and not more than five years imprisonment and damages of not less than £12,500 and not more than £100,000;
            d.     the fourth degree shall be punished by a term of not more than six months imprisonment and damages of not more than £50,000;
            e.     the fifth degree shall be punished by damages of not more than £100,000;
            f.     the sixth degree shall be punished by damages of not more than £50,000;
            g.     the seventh degree shall be punished by damages of not more than £25,000.
