Chapter 4. Inchoate Crimes.

§ 401. Solicitation.

    1.    No person shall be convicted of solicitation of a crime unless it can be proven that he, with the intent of promoting or facilitating its commission, he commands, encourages or requests another person to engage in specific conduct that would constitute such crime or an attempt to commit such crime or would establish another person as an accomplice in its commission or attempted commission.

    2.    It is an affirmative defence that the defendant, after soliciting another person to commit a crime, persuaded or attempted to persuade him not to do so or otherwise prevented the commission of the crime, under circumstances manifesting a complete and voluntary renunciation of his criminal intent.

    3.    Solicitation to commit a crime punishable by imprisonment shall be punished by a term of imprisonment of one-half the sentence for the crime attempted, and damages of two-thirds the damages awarded for the crime attempted.

    4.    Solicitation to commit a crime not punishable by imprisonment shall be punished by damages of two-thirds the damages awarded for the crime attempted.
