Chapter 1. General Provisions

§ 101. General Definitions.

    1. "Statute" includes the Constitution of L'nhraei, any act of the Assembly, and any local law or ordinance of a political subdivision of the State.

    2. "Code" means Title V of the L'nhraei Code.

    3. "Act" or "action" means a bodily movement whether voluntary or involuntary.

    4. "Voluntary" has the meaning specified in § 200.

    5. "Omission" means a failure to act when there is a legal duty to act.

    6. "Conduct" means an action or omission and its accompanying state of mind, or, where relevant, a series of acts and omissions.

    7. "Acted" includes, where relevant, "omitted to act".

    8. "Person", "he", and "defendant" include any sentient being, regardless of sex, and, where relevant, a business.

    9. "Plaintiff" includes a person represented in court by another person due to infancy, incompetence, or death; and includes any person from fertilisation until death

    10. "Element of a crime" means such conduct or such attendant circumstances or such a result of conduct as

            a) is included in the description of the forbidden conduct in the definition of the crime; or

            b) establishes the required kind of liability; or

            c) negates an excuse or justification for such conduct; or

            d) negates a defence under the statute of limitations; or

            e) establishes jurisdiction or venue.

    11. "Material element of a crime" means an element that does not relate exclusively to the statute of limitations, jurisdiction, venue, or to any other matter similarly unconnected with the harm or evil, incident to conduct, sought to be prevented by the law defining the crime, or the existence of a justification or excuse for such conduct.

    12. "Intentionally" has the meaning specified in § 201 and equivalent terms such as "with intent" or "intended" have the same meaning.

    13. "Recklessly" has the meaning specified in § 201 and equivalent terms such as "recklessness" or "with recklessness" have the same meaning.

    14. "Negligently" has the meaning specified in § 201 and equivalent terms such as "negligence" or "with negligence" have the same meaning.

    15. "Reasonably believes" or "reasonable belief" designates a belief that the defendant is not reckless or negligent in holding.

    16. "Knowingly" and terms such as "know" or "known" require the defendant to have actual knowledge of the fact required for liability.

    17. "Homicide" includes murder, manslaughter, and wrongful death.

    18. "Police" includes any person, business, or organisation, public or private, whose main duty is preventing or investigating crime, or any person in the act of arresting another person.

    19. "Dependent child" means a person dependent on his parents or guardian for food and shelter and unable to provide for himself due to youth or incompetence.

    20. "Crime punishable by imprisonment" shall not include debt.

    21. "Crime not punishable by imprisonment" shall include debt.
